PLEASE READ CAREFULLY. BY SIGNING THIS WAIVER, YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CLAIMS ARISING FROM ORDINARY NEGLIGENCE. 1. Definitions "Prairie Fire" means Prairie Fire Grappling LLC. "Activities" means Brazilian jiu-jitsu, submission grappling, wrestling, throws, takedowns, self-defense, striking drills if offered, conditioning, warmups, drilling, sparring or rolling, open mats, private lessons, classes, events, and use of the mats, equipment, and facility located at 231 West Main Street, Council Grove, Kansas 66801. "Released Parties" means Prairie Fire; its owners, members, managers, instructors, coaches, employees, contractors, volunteers, agents, insurers, successors, and assigns; the owner and lessor of the facility; and other participants in the Activities. "Participant" means the person participating in the Activities. 2. Acknowledgment and Assumption of Risk I understand that the Activities involve strenuous physical exertion, close physical contact, falling, throwing, choking and strangulation techniques, joint locks, twisting, compression, takedowns, unpredictable actions by other participants, and other risks inherent in combat sports and grappling training. The risks include, but are not limited to, falls, collisions, improper or unsuccessful techniques, delayed releases after submission, differences in participant size or ability, equipment or mat conditions, overexertion, dehydration, infections, communicable illness, cuts, bruises, sprains, strains, fractures, dislocations, concussions, spinal injuries, nerve injuries, loss of consciousness, paralysis, permanent disability, and death. I voluntarily participate and knowingly assume all known and unknown risks connected with the Activities. 3. Release and Waiver of Liability TO THE FULLEST EXTENT PERMITTED BY KANSAS LAW, I, ON BEHALF OF MYSELF, THE PARTICIPANT, AND MY OR THE PARTICIPANT'S HEIRS, ESTATE, PERSONAL REPRESENTATIVES, NEXT OF KIN, AND ANY PERSON CLAIMING THROUGH ME OR THE PARTICIPANT, RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, MEDICAL EXPENSES, ATTORNEY FEES, AND COSTS ARISING FROM OR RELATED TO THE PARTICIPANT'S PARTICIPATION IN THE ACTIVITIES OR PRESENCE AT THE FACILITY. THIS RELEASE EXPRESSLY INCLUDES CLAIMS CAUSED IN WHOLE OR IN PART BY THE ACTIVE OR PASSIVE ORDINARY NEGLIGENCE OF A RELEASED PARTY. This Waiver does not release gross negligence, reckless conduct, willful or wanton conduct, intentional misconduct, or any other claim that Kansas law does not permit to be released. 4. Covenant Not to Sue I agree not to bring or maintain a lawsuit, arbitration, demand, or other legal claim against any Released Party for any claim released by this Waiver. 5. Participant Responsibility and Rules The Participant is responsible for determining whether the Participant is physically and medically capable of participating. The Participant agrees to follow all safety instructions, train with care, respect training partners, immediately release a technique when another participant submits, and stop participating when continued participation feels unsafe. The Participant agrees not to participate while sick, contagious, impaired, or while having any open wound, skin infection, or rash. 6. Medical Treatment and Emergency Authorization I authorize Prairie Fire and its staff to seek emergency medical care for the Participant if they believe it is necessary. I accept full responsibility for all medical and emergency expenses resulting from participation. 7. Communicable Disease and Skin Infection Acknowledgment I understand the Activities involve close physical contact and may involve exposure to communicable diseases and skin infections even when the facility follows cleaning practices. The Participant agrees not to train with known or suspected contagious illness or infection. 8. Photo, Video, and Media Consent I grant Prairie Fire permission to photograph or record the Participant during activities and to use these for lawful business, promotional, website, social media, or advertising purposes without compensation. To opt out, I must notify Prairie Fire in writing. 9. Minor Participant / Parent or Legal Guardian Acknowledgment If the Participant is under 18, I certify that I am the parent or legal guardian with legal authority to sign this Waiver on the minor's behalf, and I voluntarily allow the minor to participate. To the fullest extent permitted by Kansas law, I release the Released Parties from claims brought through me and agree to defend and indemnify them from claims brought by or on behalf of the minor. 10. Auto-Withdraw Membership Acknowledgment If the Participant enrolls in a recurring membership, I understand the membership may auto-withdraw until canceled according to the payment terms selected during enrollment. 11. Kansas Law and Severability This Waiver is governed by Kansas law. If any provision is found unenforceable, it shall be limited or removed only to the extent necessary, and the remaining provisions shall remain effective. 12. Acknowledgment and Signature I have read this entire Waiver, understand its terms, understand that I am giving up substantial legal rights, and sign it knowingly and voluntarily.
